Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Callita AI receptionist platform operated by Linea Holdings ("Callita," "we," "us," or "our"). By signing up for or using our services, you agree to these Terms.
1. Service Description
Callita provides an AI-powered virtual receptionist service for businesses. Our service answers incoming phone calls on your behalf, collects caller information, and delivers lead details to you via SMS and through your online dashboard at app.callita.ai.
2. Account Registration
To use Callita, you must create an account and provide accurate business and contact information, including your name, email, phone number, and business name. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. SMS Messaging Terms
By providing your phone number during signup, you expressly consent to receive recurring transactional SMS messages from Callita. These messages include:
- Account activation and welcome messages
- Real-time lead and call notifications
- Trial status and subscription reminders
- Payment confirmations and failure alerts
- Weekly performance summaries
Message frequency varies based on your incoming call volume and account activity. Message and data rates may apply depending on your mobile carrier and plan.
To opt out of SMS messages, reply STOP to any message from Callita. After opting out, you will receive a confirmation message and no further SMS messages will be sent. Note that opting out of SMS may limit certain service features such as real-time lead notifications.

Supported carriers include all major US carriers. Callita is not responsible for delayed or undelivered messages caused by carrier issues.
4. Free Trial
New accounts may include a free trial period. During the trial, you have full access to the Callita service including your dedicated AI receptionist and phone number. At the end of the trial period, your subscription will begin and you will be charged the applicable subscription fee unless you cancel before the trial ends.
5. Pricing and Payment
Callita subscription plans are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by law. If a payment fails, we will notify you via SMS and email. Continued payment failure may result in suspension or termination of your service.
6. Phone Numbers
As part of your subscription, Callita provisions a dedicated phone number for your business. This number is owned by Callita and is assigned to your account for the duration of your active subscription. If your subscription is cancelled or terminated, the phone number may be released and reassigned.
7. AI Service Limitations
Callita's AI receptionist is designed to handle common business inquiries and collect caller information. However, the AI may not perfectly handle every call scenario. Callita is not a substitute for emergency services, licensed professional advice, or human judgment in critical situations. We continuously improve our AI but do not guarantee error-free performance.
8. Acceptable Use
You agree not to use Callita for any unlawful purpose, to transmit spam or unsolicited messages, to misrepresent your identity or business, or to interfere with the operation of our platform. We reserve the right to suspend or terminate accounts that violate these terms.
9. Data and Privacy
Your use of Callita is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using our services, you consent to the practices described in the Privacy Policy.
10. Service Availability
We strive to maintain 99.9% uptime for our AI receptionist service. However, we do not guarantee uninterrupted service and are not liable for any downtime, whether planned or unplanned. We will make reasonable efforts to notify you in advance of planned maintenance.
11. Limitation of Liability
To the maximum extent permitted by law, Callita and Linea Holdings shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services, including but not limited to lost revenue from missed calls or inaccurate AI responses. Our total liability shall not exceed the amount you paid for the service in the three months preceding the claim.
12. Termination
You may cancel your subscription at any time through your dashboard at app.callita.ai or by contacting us. We may terminate or suspend your account for violation of these Terms or for non-payment. Upon termination, your AI receptionist and assigned phone number will be deactivated.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or SMS. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the Commonwealth of Puerto Rico. Any disputes shall be resolved in the courts of San Juan, Puerto Rico.
